It explains what personal information we collect when you use this site, why we collect it, and how you can ask questions or make requests about it. We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario law.
When you fill out a form on this site — to ask a question, request a cash offer, request the private lender packet, join the buyer list, subscribe to the newsletter, or request a free guide or checklist — we collect what you choose to give us. Depending on the form, that may include your name, email address, phone number, property address, and any details you write in about your situation. We don't ask for anything beyond what's needed to respond to that specific request.
We use the information you submit for one purpose: to respond to you. That means contacting you about the house, the loan, the deal, or the question you raised, and — where you've asked for one — sending the guide, checklist, or newsletter you requested. We do not sell, rent, or trade your personal information to third parties.
Form submissions are processed and stored using GoHighLevel (GHL), our customer relationship management platform, so that we can track and follow up on your enquiry. Email and text follow-ups may come from Cactus Capital using that same system. You can ask to be removed from these communications at any time — see "Your choices" below.
This site uses Google Analytics 4 to understand, in aggregate, how visitors use the site — which pages get read, roughly how people arrive here. It also has a Meta (Facebook/Instagram) pixel installed, which allows us to build an audience for future advertising and measure ad performance. Both tools use cookies or similar technology and may collect information such as your browser, device, approximate location, and pages viewed. We do not use these tools to identify you personally, and we do not currently run active ad campaigns using pixel data. You can limit this tracking through your browser's cookie settings or by using an ad blocker.
Your information is seen by Michael Nikolica and anyone he directly authorizes to help operate Cactus Capital (for example, someone assisting with follow-up or administration). It is also processed by the service providers named above (GoHighLevel, Google Analytics, Meta) strictly to provide those services. We don't share it with unrelated third parties.
We keep the information from your enquiry as long as it's reasonably needed to respond to you, follow up on an active or possible deal, or meet a legal or bookkeeping requirement. If you ask us to delete your information and there's no legal reason to keep it, we will.
You can ask, at any time, to see what personal information we hold about you, to correct it, to have it deleted, or to stop receiving emails or texts from us (every email includes an unsubscribe link, and you can reply STOP to any text). To make any of these requests, email [email protected].
This site and its forms are intended for adults making decisions about real estate, lending, or business partnerships. We don't knowingly collect personal information from children.
